Is Transition From the Concept of Private Financial Institution to Participation Bank a Paradox, Over Against the Concept of Islamic Banking?

Abstract
Interest free banking has been in use for 30 years in Turkey and we can divide the legal development and framework of Islamic banking into three periods. On the other hand, after enactment of Banking Law No.5411, new era opened for Islamic banking in Turkey and the term of participation bank is adopted in liue of private financial institution. On the other hand, as all kind of interest is prohibited, riba (interest) is one of the elements which directly affects the structure of an Islamic financial system and in most of the countries law system, the concept of Islamic banking is used to determine these kinds of financial institutions. From this point of view, it is vital to clarify if it is a paradox or not to use the term of participation bank in liue of Islamic bank in Turkish banking law.

İslami Banka Kavramı Karşısında Özel Finans Kurumundan Katılım Bankası Kavramına Geçiş Bir Çelişki Midir?

Ozet
Türkiyede faizsiz bankacılık yaklaşık 30 yıldır uygulanmakta olup, bu tür bankacılığın hukuki gelişimini ve çerçevesini, üç ayrı döneme ayırarak inceleyebiliriz. Diğer taraftan, 5411 sayılı Bankacılık Kanununun yürürlüğe girmesiyle birlikte, Türkiyede faizsiz bankacılık için yeni bir çağ açılmış ve faizsiz bankacılık temelinde faaliyetlerini sürdüren bankalar, özel finans kurumu yerine katılım bankası olarak adlandırılmaya başlanmıştır. Diğer taraftan; İslam hukukunda her türlü faiz yasaklandığından, riba kavramı, İslami finansal sistemi doğrudan etkileyen unsurlardan biri olarak karşımıza çıkmaktadır. Gerçekten, birçok ülke mevzuatında da İslami banka kavramı bu tür kurumları tanımlamak için kullanılmıştır. Bu açıdan bakıldığında, Türk hukukunda faizsiz bankacılık temeline dayalı olarak faaliyetlerini sürdüren bu tür kurumlar için katılım bankası kavramının kullanılmasının, İslami banka kavramı karşısında bir çelişki olup olmadığının açıklığa kavuşturulması önem arz etmektedir.
